Urbani Furniture – Terms and Conditions
These terms and conditions govern your use of this website and any purchase you make.
Please read the information carefully, by using the site you acknowledge, understand, and agree to be bound to the terms and conditions.
Agreement of Orders Placed
This agreement is between you and Urbani Furniture. Each item placed on our website is listed only as an ‘invitation to treat’. Your use of any buying functionality on this website is an ‘offer’ and an agreement is not completed until it has been accepted by us. We reserve the right at our absolute discretion to refuse purchases. This is largely due to the popularity or interruption of supply for some items meaning they may be unavailable or out of stock.
We deliver within 20km of the Perth Metro area, and not to regional WA. We reserve the right to decline to deliver an item to your address. We provide a drive way drop-off only.
Price and Payment
All prices are in Australian Dollars. Full payment is required at the point of sale. We utilize the services of a third party payment processor (PayPal). By placing an order on our site you agree to their terms and conditions. We will always endeavor to be as accurate as possible, however, we are unable to warrant the product descriptions, prices or any other content will be error free at all times, and reserve the right to make changes after a purchase has been made and notify you of this change as soon as possible.
Delivery of Orders Placed
Please note, we only delivery to the Perth metro area. Delivery costs are not included in the price of items.
Risk in any goods supplied to you will pass to you when we part with possession of the goods, or the goods leave our premises, or are delivered to you or at the time you paid for the goods, whichever is the earlier.
Retention of Title
Title to the goods shall pass to you on payment of the full price.
You shall inspect the goods on delivery and notify us on delivery of any alleged defect, shortage in quantity, or damage. If you fail to comply with these provisions the goods shall be conclusively presumed to be in accordance with the terms and conditions and free from any defect or damage.
We ensure our outdoor furniture is suitable for outdoor use in the harsh Perth climate. Our wicker and fabric are UV protected, and water proof. Our aluminium powder coated frames are rust resistant and suitable for outdoor weather.
Care and maintenance can increase the lifespan of your outdoor furniture. It is recommended that a cover be used for furniture when not in use. Prolonged exposure to high UV sunlight can cause fading of cushions.
In addition to your rights under the Consumer and Competition Act (2010), and any relevant legislation, we issue the following warranty.
Aluminium frames are covered by a 3 year structural warranty. This excludes damage to the powder coated finish.
Cushions are covered by a 1 year limited warranty. This excludes stains, mildew, fading and stretching of fabric, and flattening of cushions.
PE wicker is covered by a 1 year limited warranty. This excludes scratching of the finish, unravelling of the wicker, staining or discolouration, or fading from exposure to direct sunlight.
We do not provide a refund for change of mind. For faulty products we provide a refund, repair or replacement in accordance with the Consumer Competition Act (2010).
Use of Site
You may not use our website site for any other purpose than that of purchasing goods from and/or using it to be informed of products and services.
Intellectual Property Rights.
Any trade marks, logos, pictures, images or text featured on the site are not to be copied or used for any purpose without our prior written consent.
If any part or parts of this Agreement shall be held unenforceable for any reason, the remainder of this Agreement shall continue in full force and effect.
This Agreement shall be governed by and construed in accordance with the laws of Western Australia.
